Registered Training Organisations (RTOs) are unlike any other type of business. In all states except for Victoria and Western Australia, RTOs are regulated by the Australian Skills & Quality Authority (ASQA) under the VET Quality Framework. There are strict compliance requirements and significant penalties for non-compliance.
If you are considering buying or selling an RTO, you need a commercial lawyer with expertise in RTO transactions to protect your interests and reduce your risk.
An RTO business is not automatically transferrable from a seller to a buyer as may be the case with a normal business transaction. The sale of an RTO business must be structured differently to the usual business transaction. There are a number of areas that require specialist advice for both a seller and a buyer.
Our lawyers have the required experience and specialist knowledge to provide you with the advice required and run the transaction from start to finish.
