Tony Cavanagh

Tony is a former Director of the firm, who now practices as a Consultant in our 'Disputes, Claims, Litigation' and 'Employment, Workplace' groups.

He has been practising law since 1984. He was a principal of Mullane & Lindsay from 1993 until July 2020. 

Tony has practised in many areas of commercial litigation, such as disputes over contractual interpretation or termination of contracts, e.g. for the supply of goods or services or for the sale of businesses or property; claims of misleading or deceptive conduct or other matters involving allegations of breaches of the Fair Trading Act (NSW) or the Australian Consumer Law (formerly the Trade Practices Act); restraint of trade and confidential information disputes; winding up insolvent companies and associated actions such as insolvent trading, unfair preferences etc; shareholder or partnership disputes and property damage and loss of profit claims for businesses and individuals.

He also advises and acts for both workers (including professionals and senior executives) and employers in termination of employment claims; general protection or ‘adverse action’ disputes and on contractual, industrial and workplace issues generally. Tony was for many years a Conjoint Lecturer in Employment Law in the Faculty of Law at The University of Newcastle, and he continues to lecture law students at the University of Newcastle in relation to legal practice and risk issues.

Mullane & Lindsay has developed a special expertise in the areas of professional indemnity and general insurance claims, and Tony has been both our liaison director for insurer clients and also a 'hands on' practitioner in insurance litigation of various kinds; involving the investigation of claims and the provision of detailed advice on merits, strategy and damages. He has acted for a number of general and indemnity insurers, including Lawcover Insurance Pty Limited, the dominant professional indemnity insurer of solicitors in NSW and the ACT. He has been published regularly in legal progressional journals; and has presented to a range of professional groups on both 'black letter' and risk management issues in Australia and overseas. He has been retained to prepare submissions to the NSW government on law reform issues, especially in relation to insurance law issues.

Tony is or has been a member of the Australian Insurance Institute, the Australian Insurance Law Association, the Australian Lawyers Alliance and the Industrial Relations Society of NSW. He was a NSW Law Society Accredited Specialist in personal injury law from 1994 – 2013. He has been both Secretary and Treasurer of Newcastle Law Society, a member of the Criminal Law committee of the Law Society of NSW and Chair of the NSW Young Lawyers Criminal Law committee. He is the honorary solicitor for a number of sporting groups, including the Newcastle Baseball Association.

He graduated from Sydney University in 1984 with BA (Hons) LLB. Tony is also a Notary Public.
